JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased. The marriage of the petitioner had taken place with the deceased in the year 2009 but she died on 16.07.2014 and her dead body was disposed of without giving information to the parents of the deceased . The informant lodged the present case on 19.07.2014. From perusal of the impugned order, it would appear that except the informant not a single witness supported the prosecution story rather the prosecution witnesses stated that deceased died of abdominal pain and bleeding. Moreover, the submission on behalf of the petitioner is that the informant lodged

Patna High Court Cr.Misc. No.7134 of 2016 (2) dt.16-02-2016 2/2 the present case due to some misconception but when he learnt the real fact, he filed compromise petition before the court below which is Annexure-2 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-14, Motihari, East Champaran in connection with Sangrampur P.S.Case No. 85 of 2014.
