The petitioner is in custody in connection with Naubatpur P.S. Case No. 375 of 2017 for the offences under Sections 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 03.11.2018. He further submits that allegation against the petitioner is that he has looted Rs.1,00,000/-. Referring to the prosecution case, Mr. Yogesh Chandra Verma, learned senior counsel submits that the story has been planted in the instant case which is beyond comprehension of any reasonable man. He submits that the

Patna High Court Cr.Misc. No.4244 of 2019(2) dt.28-01-2019 2/2 informant has mentioned that petitioner has carried the informant to show the Marble cutting machine and when he reached there 6-7 boys were already sitting and snatched rupees one lac from informant.

Considering the aforesaid, including the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate 1st, Danapur, Patna in connection with Naubatpur P.S. Case No. 375 of 2017.
