The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 417, 465 and 471 of the Indian Penal Code.

As per the prosecution case, this petitioner along with one Chandra Shekhar Sah took Rs. 1,22,000/- from the complainant to get admission in nursing course in Shekhar Para Medical and Engineering College, Begusarai which was registered with Sambauta Madhya Pradesh Nursing Registration Council, Bhopal and organized a fake examination of Ist year, but neither result of Ist year examination nor admit card of 2nd

Patna High Court CR. MISC. No.2319 of 2023(2) dt.08-05-2023 2/2 year examination was provided to the complainant. It is submitted that specific accusation is against coaccused Chandra Shekhar Sah. Petitioner is only alleged to have introduced the complainant with co-accused Chandra Shekhar Sah. There is no allegation that petitioner has not taken any money from the complainant. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Rosera, Samastipur in connection with Complaint Case No. 16 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
