JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The trial court has reported that POCSO Case No. 04 of 2014 arising out of Chapra Town P.S. Case No. 145 of 2014 is pending for argument.
It is informed on behalf of the petitioner that the concerned Presiding Officer has already been transferred and now, the court of 1st Additional Sessions Judge, Saran at Chapra is lying vacant.
Considering the aforesaid submission as well as report of 1st Additional Sessions Judge, Saran at Chapra, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with POCSO Case No. 04 of 2014 arising out of
Patna High Court Cr.Misc. No.9032 of 2016 (3) dt.27-07-2016 2/2 Chapra Town P.S. Case No. 145 of 2014 stands rejected. However, the learned Sessions Judge, Saran at Chapra is directed to ensure the disposal of aforesaid case within a month from the date of receipt/production of copy of this order, failing which the matter shall be viewed seriously.
