The petitioner seeks regular bail in connection with Sachivalay P.S. Case No. 244 of 2019 for the offence punishable under Sections 356 and 379 of the Indian Penal Code. The allegation is regarding unknown miscreants having stolen mobile of the informant.

The learned counsel for the petitioner has submitted that the petitioner has been falsely roped in the present case upon confessional statement made by the co-accused person, namely, Munna and no recovery of stolen articles have been made from the possession of the petitioner. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 26.9.2019.

No.3858 of 2020(2) dt.21-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that stolen articles have not been recovered from the possession of the petitioner, the petitioner is having a clean antecedent and is languishing in custody since 26.09.2019, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Patna in connection with Sachivalay P.S. Case No. 244 of 2019.
