====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 11-01-2022 Heard learned counsel for the petitioners, informant and learned Additional Public Prosecutor for the State through the virtual court proceeding.

Learned counsel for the petitioners undertakes to remove the defects within three weeks. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 304(B), 201 and 34 of the Indian Penal Code.

Allegation against the petitioners is that they killed

Patna High Court CR. MISC. No.13357 of 2021(2) dt.11-01-2022 2/2 the sister of the informant by hanging her and threw her dead body in well with intention of screen the dead body of victim. It is submitted by learned counsel for the petitioners that petitioners are innocent and have been falsely implicated in this case. He submits that there is general and omnibus allegation levelled against the petitioners. Husband of the deceased is already in judicial custody since 14.08.2020. He further submits that petitioners have one criminal antecedent as stated in para-3 of this application.

Learned APP for the State and informant oppose the prayer for bail and submit that petitioners are also involved in the present case and all the witnesses have supported the prosecution case.

Considering the nature of allegation, I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for anticipatory bail is rejected in connection with Isipur (Barahat) P.S. Case No. 49 of 2020.
