Petitioner seeks bail in connection with Ramnagar P.S. Case No. 226 of 2015 registered for the offence punishable under Section 366 of the Indian Penal Code.
Allegedly, the petitioner kidnapped Shushila Devi, the daughter-in-law of the informant, at the point of firearm in presence of the wife of the informant. During investigation the statement of victim was recorded under Section 164 Cr.P.C. wherein she has supported the allegation of kidnapping and that she was forcibly raped by the petitioner.
Submission is of false implication, both are major, no offence is made out, the victim is mother of three children and during medical examination no sign of recent sexual intercourse
Patna High Court Cr.Misc. No.6140 of 2016 (2) dt.24-02-2016 was found to which Sri B. N. Pandey, A.P.P. opposes. In the facts and circumstances stated above, considering the statement of the victim recorded under Section 164 Cr.P.C., this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.
