JUSTICE PARTHA SARTHY ORAL ORDER 09-07-2021 Heard learned counsel for the petitioner and learned counsel for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Tankuppa P.S. Case no. 68 of 2020 registered under sections 498A, 306, 201 and 34 of the Indian Penal Code.

As per allegation in the FIR, the daughter of the informant was married to the son of the petitioner herein about 22 years ago. A daughter was born out of the said wedlock. It is stated that the informant received information on telephone that his daughter had committed suicide. The body had been disposed off.

It is submitted by learned counsel for the petitioner that the petitioner is the old father-in-law of the deceased. It was as a result of a trivial dispute in the family that she committed suicide. The petitioner is in custody since 7.9.2020 and has no criminal antecedent. Charge sheet has been submitted under section 306 and other sections of the IPC.

Having heard learned counsel for the parties and taking into consideration that the investigation in the case has concluded and the petitioner being in custody for the last 10 months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Tankuppa P.S. Case no. 68 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Gaya.
