JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sadar (Mofassil) P.S. Case No. 369 of 2012 registered under Sections 323, 341, 364, 498A and 304B of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected twice vide order dated 28.01.2014 and 15.10. 2014 passed in Cr. Misc. Nos. 30046 of 2013 and 40264 of 2014 respectively by this Court and he is in custody since 01.05.2013. It is further submitted that case of the petitioner has been committed to the court of sessions numbered as Sessions Trial No. 1487 of 2012 pending in the court

Patna High Court Cr.Misc. No.7664 of 2015 (3) dt.15-04-2015 of 2nd Additional Sessions Judge, Purnea, where four charge sheeted witnesses have been examined including informant, Md. Jagir, (P.W.4) but none have supported the prosecution case about making demand of dowry by this petitioner.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Purnea, in connection with Sessions Trial No. 1487 of 2012/1238 of 2013 arising out of Sadar (Mofassil) P.S. Case No. 369 of 2012 Out of two sureties, one surety must be parents or close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
