The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

As per allegation in the FIR, pull cart of the informant's son was damaged by the petitioner over which informant's son asked him for repairing the said pull cart. Then petitioner and several other persons armed with deadly weapons came there and caught hold the petitioner and started to assault him and when Jai Prakash Kushwaha came to save him, he was also beaten up by them.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.3943 of 2023(2) dt.04-02-2023 2/2 that petitioner has been falsely implicated in this case due to previous enmity. No any overt act is alleged against the petitioner. Similarly situated co-accused Vikash Pas has granted bail by learned lower court. The petitioner has no criminal antecedent and he is languishing in judicial custody since 28.10.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No. 220 of 2020.
