JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-02-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Hasanpur P.S. Case No. 29 of 2014 registered for the offences punishable under Sections 363, 364A of the Indian Penal Code. The son of the informant became traceless since 29.3.2014 and later on, on 2.4.2014 ransom was demanded, subsequently witnesses, during investigation, stated the name of the petitioner and others.

Submission is of false implication and the petitioner is cousin of the informant and has no criminal antecedent, there is land dispute and due to that the petitioner has been got implicated in the present case and other co-accused Mithilesh Yadav, Banarsi

Patna High Court Cr.Misc. No.6091 of 2016 (2) dt.23-02-2016 2/2 Yadav, Dilip Kumar, Deepak Kumar have already been allowed bail by different co-ordinate Benches of this Court and as such the petitioner also deserves sympathetic consideration to which learned A.P.P. is not in a position to distinguish the case of the petitioner from those accused persons who have been allowed bail. In the facts and circumstances stated above, the petitioner is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri K. Kumar, Judicial Magistrate, 1st Class, Rosera, in connection with Hasanpur P.S. Case No. 29 of 2014, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
