JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Ghanshyampur P.S. Case No.66 of 2019 registered for the offence punishable under Sections 498A and 302/34 of the Indian Penal Code.

The petitioner is the husband of the deceased. All the family members of the petitioner have been implicated in the criminal case. The marriage between the petitioner and the deceased was solemnized in 2005. It has been alleged in the First Information Report that the petitioner and his family members used to torture the deceased variously. From the second portion of the First Information Report, it appears that the statement of the victim was recorded after she was taken to hospital after receiving burn injuries. Her

Patna High Court CR. MISC. No.1566 of 2020(3) dt.05-06-2020 2/2 statement was video recorded. She had disclosed, at that point of time, that accidentally her clothings had caught fire, leading to the burn injuries. It is the allegation of the informant, who is father of the deceased, however, that the deceased was caused by her in-laws to make such statement.

Be that as it may, there being admitted fact that statement of the victim was recorded, which did not disclose commission of any offence, as alleged, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biraul, District-Darbhanga, in Ghanshyampur P.S. Case No. 66 of 2019.
