JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 28-04-2015 Heard learned counsels for the petitioner, State and the informant.

The petitioner is languishing in custody since 07.01.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 326, 307 of the Indian Penal Code and 27 of the Arms Act.

It is alleged against the petitioner that the petitioner caused firearm injury to the informant whereas coaccused Sadhu Yadav caused firearm injury to the uncle of the informant and thereafter uncle of the informant was assaulted by other accused persons. The informant has received five injuries, out of which four have been found to be simple in nature whereas with regard to 5th injury opinion has been reserved.

No.14242 of 2015 (02) dt.28-04-2015 2/2 It is submitted by learned counsel for the petitioner that there is a counter version of the occurrence also and petitioner side also received firearm injuries. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and the investigation has already concluded. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Nalanda at Biharsharif in connection with Sare P.S. Case No. 79 of 2014.
