1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Sonbersa P.S. Case no. 318 of 2023 registered under section 21(b)(c) of the N.D.P.S Act.
3. As per the prosecution case, the informant states that on information having been received, raid was conducted and intoxicated cough syrups were found being sold from the shop of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from the petitioner's
Patna High Court CR. MISC. No.4718 of 2024(2) dt.07-02-2024 2/2 possession. There is violation of sections 42 and 50 of the NDPS Act. The petitioner is in custody since 16.10.2023 and has no criminal antecedent. Charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, the contents of the articles recovered, the petitioner not having any criminal antecedent, his being in custody since 16.10.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sonbersa P.S. Case no. 318 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge-cum-Special Judge NDPS, Sitamarhi.
