The petitioner seeks bail in Sarai P.S. Case No. 125 of 2014, registered for the offences punishable under Section 395 of the Indian Penal Code.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner was apprehended and his confessional statement was obtained and except the confessional statement of the petitioner and other accused persons, there is no evidence to show the involvement of the petitioner in the alleged dacoity. The petitioner was not even put on test identification parade. Nageshwar Das and Satish Singh @ Bhola Singh have already been enlarged on bail vide orders passed in Cr. Misc. No. 46987 of 2014 and Cr. Misc.

Patna High Court Cr.Misc. No.10182 of 2015 (2) dt.13-03-2015 2/2 No. 49205 of 2014.

Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 125 of 2014.
