JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Vaishali P.S. Case No. 236 of 2021 instituted for the offences under Sections 413 and 414 of the Indian Penal Code read with Sections 30(a) and 41(1) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 17.06.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the allegation is of recovery of 100 litres of liquor alleged to be carried by the petitioner in a sack along with Nagendra Mahto. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, neither the

No.2808 of 2022(2) dt.04-03-2022 2/2 petitioner nor Nagendra Mahto had any connection with the sack, the real culprits on seeing the police had thrown the sack and the petitioner being a passerby came to be implicated. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Act, Vaishali in connection with Vaishali P.S. Case No. 236 of 2021.
