This is an application for bail in a case of misuse.
The petitioner being the brother of the husband of the complainant was earlier granted bail in a complaint case in which processes were directed to be issued after cognizance being taken for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of Dowry Prohibition Act. The petitioner's bail bond was cancelled on 07.03.2005 and the petitioner was ultimately arrested on 30.07.2014. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.4483 of 2015 (03) dt.02-03-2015 2/2 petitioner that the petitioner could not appear was he was under impression that the matter has been compromised between the parties. The petitioner will appear regularly henceforth. Considering the nature of accusation and the present undertaking on behalf of learned counsel for the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Complaint Case No. 1125(C) of 2002, Trial No. 2151 of 2014. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions.
