2. The petitioner seeks regular bail in connection with Darbhanga Sadar P.S. Case No. 765 of 2023 registered on 03.11.2023 under Sections 396 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against unknown accused persons against whom there is an allegation that they have committed dacoity in the house of the informant.

4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 10.11.2023 having no criminal case pending

Counsel for the petitioner submits that name of the petitioner has figured in this case by virtue of confessional statement of the co-accused. In the investigation, the material recovered is melted gold which is of petitioner as he is operating shop of jewelery. Charge-sheet has already been filed.

6. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner, above named, be granted bail one month after framing of charge and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 765 of 2023, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
