No. 01 of 2019 has been filed on behalf of the petitioner stating therein that during the pendency of this application, the petitioner no. 1 namely, Upendra Ram, has died on 11.08.2019. Accordingly, the submission is for expunging the name of petitioner no. 1 and substitution of his legal heirs, whose details are mentioned in paragraph 3 of the interlocutory application.

Taking into consideration the nature of prayer, I. A.

Patna High Court C.Misc. No.48 of 2019(2) dt.02-11-2022 2/2 No. 01 of 2019 is allowed and the name of petitioner no. 1, Upendra Ram, is expunged and in his place, the legal heirs of the petitioner no. 1 are substituted.

Learned Counsel for the petitioner seeks permission to withdraw this application, with liberty to file civil revision application.

Permission is granted.
