JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 22.10.2014 in a case registered for the offences punishable under Sections 392 and 411 of the Indian Penal Code. It is alleged that three miscreants robbed the motorcycle of the informant. Subsequently, the informant chased the miscreants along with police personnel, when Bhola Mandal and Anant Kumar were apprehended from whose possession arms were recovered who disclosed the name of petitioner being their associate who escaped from the scene.
It is submitted by the learned counsel for the petitioner that except the confession of the apprehended accused, there is no evidence collected against the petitioner. Statement has been made in paragraph 8 of the petition that the petitioner has not been put
Patna High Court Cr.Misc. No.15034 of 2015 (3) dt.12-05-2015 2/2 on Test Identification Parade and the investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhagalpur in connection with Kajraili P.S. Case No. 72 of 2014.
