JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 21.02.2015 on the accusation that he was caught by the informant and others when he made attempt to kidnap the minor daughter of the informant. Submission on behalf of the petitioner is that no such occurrence, as alleged in the written report, did ever take place and as a matter of fact , some altercation had taken place between the parties on the point of sitting on the platform at the time of journey and, thereafter, the informant lodged this false case with concocted story and, moreover, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as

No.5461 of 2016 (2) dt.15-02-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Gaya in connection with Rail Gaya (G.R.P.S) Case No. 94 of 2015.
