The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 337, 338, 354B and 427/34 of the Indian Penal Code. The prosecution case as per the written report of Anita Devi submitted to Station House Officer of Kateya Police Station, is to the effect that on 27.10.2019 at 9.00 P.M. all the seven accused persons including the petitioners came and alleged that the daughter of the accused persons eloped with Amarjeet, the son of the informant, as a result, petitioner no. 1,

Patna High Court CR. MISC. No.1191 of 2020(2) dt.25-02-2020 2/3 Anmol Kumar Singh, petitioner no. 2, Tarzan Singh and coaccused Manshi Singh assaulted with lathi on the head of the informant. Thereafter, the informant was assaulted by coaccused Hariom Singh, petitioner no. 2, Krishna Kumar Kushwaha, petitioner no. 3, Anmol Kumar Singh and petitioner no. 5, Bidhya Singh.

It is submitted by learned counsel for the petitioners that the informant's son Amarjeet eloped with the daughter of Daroga Singh, leading to registration of Kateya P.S. Case No. 283 of 2019 under Section 366A of the Indian Penal Code against Amarjeet Singh and others and as a retaliatory measure, the present case has been lodged by the informant and the injury has been found simple in nature. A statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that the petitioners are named in the FIR.

Considering the fact that the accusation has been levelled in the background of kidnapping of a girl from the accused side and statement being made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on

No.1191 of 2020(2) dt.25-02-2020 3/3 anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Gopalganj in connection with Kateya P.S.
