The petitioner has preferred this application for grant of regular bail in a case registered under sections 395 and 397 of the Indian Penal Code.
As per allegation in the F.I.R., six accused persons on two motorcycles are stated to have broken open the cash counter of the petrol pump and of having taken away Rs.1.9 lacs in cash .
It is submitted by learned counsel for the petitioner that the F.I.R. was registered against six unknown. The petitioner was falsely implicated in the case based on the confessional statement of the petitioner himself recorded in another case ie. Saraiya P.S. Case no.857 of 2019. No
Patna High Court CR. MISC. No.14002 of 2021(3) dt.04-08-2021 2/2 incriminating article has been recovered from the possession of the petitioner who is in custody since 9.9.2020 and investigation in the case has concluded.
Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for more than 9 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Bhagwanpur P.S. Case no.321 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st , Vaishali at Hajipur.
