2. Though, the counsel appearing on behalf of the petitioner has tried to impress upon this Court that the legal heirs of the petitioner can be brought on record. It is to be noted that unless and until the original license holder was aged less than 58 years at the time of his death, the question of legal heirs getting any right under the compassionate appointment does not arise.

3. In this particular case as seen from the record, the

4. Having regard to the same, the present writ petition is dismissed as abated.
