The petitioner seeks bail in connection with Gopalganj P.S. Case No. 553 of 2019, registered under Section 414 of the Indian Penal Code.

The accusation is that in course of patrolling duty some boys were seen talking in suspicion condition. On seeing the police party, they started to flee away, but, three persons were apprehended, who disclosed their name Golu Tiwari, Munna Yadav and Vivek Kumar. On query, they disclosed that they use to do purchasing and selling of theft mobile and they were found in possession of some mobile sets. They also

Patna High Court CR. MISC. No.1502 of 2020(2) dt.23-01-2020 2/2 disclosed the name of Ashok Kumar @ Deepak (petitioner), Rahul Kumar and Aman Raj, who indulged in selling the stolen mobile. Thereafter, the police reached at the house of the petitioner, from where two mobile sets were seized and the petitioner was apprehended.

Submission is that only one mobile set was seized by the police from the house of the petitioner, which is purchased mobile of the petitioner in the year 2017, which would appear from Annexure 2, but, mere on suspicion, the petitioner has been remanded in this case and is in custody since 24.10.2019. Further, submission is that the petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Gopalganj P.S. Case No. 553 of 2019 to the satisfaction of the Chief Judicial Magistrate, Gopalganj.
