The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 414 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 29.09.2021, charge-sheet has been submitted in the case and has antecedent of six cases. Learned counsel for the petitioner submits that the informant alleges that Akash Paswan and Chandan Kumar were arrested during raid and from them two mobile phones and a master key was recovered along with one motorcycle. It is next alleged that on disclosure made by Akash and Chandan, one Ravikant was also arrested and on his confession, several vehicles were seized.

No.3548 of 2022(2) dt.26-05-2022 2/2 Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that Chandan and Akash disclosed the name of Ravikant and Ravikant after being arrested disclosed that he had given a stolen tractor to the petitioner for selling based on which the house of the petitioner was raided but the tractor was not found. It is next submitted that the petitioner has criminal antecedents as such the police through Ravikant got him implicated.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 29.09.2021, charge-sheet has been submitted in the case, his name came in the confessional statement of Ravikant and nothing was recovered from his house, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ghoshi (Okari) P.S. Case No. 401 of 2019 with a condition that one of the bailors of the petitioner shall be his father, Hira Rajak. (Satyavrat Verma, J) Rishi/- U T
