Patna High Court MJC No.19 of 2019 dt.20-07-2022 2/3 This application has been filed for initiating a contempt proceeding against the opposite parties for noncompliance of the judgment and order dated 29.08.2018 passed by the learned Single Judge of this Court passed in C.W.J.C. No.2613 of 2013.

A show cause dated 20.07.2022 has been filed on behalf of opposite party no.8, in which, it has been stated that in compliance of order dated 22.06.2022, the petitioner has been granted promotion to the post of Superintending Engineer from 23.9.2006 vide Road Construction Department Notification No.2800(3) dated 17.6.2022 and opposite party has also issued pay slip for pay from 23.09.2006 to 31.07.2007 and from 01.04.2007 to 30.06.2008 as well as the authority of leave encashment difference bearing No. LE 0422/2022-2023. It has been further stated that in light of the aforesaid notification, the pension and gratuity of the petitioner has been revised by the office.

In view of the above, no purpose will be served by keeping the proceeding pending any further and accordingly same is dropped.

However, the authority is directed to credit the dues amount, if any, in the bank account of the petitioner by

With aforesaid observation, the petition stands disposed of.
