JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-03-2022 At the outset, learned counsel for the petitioner is permitted to correct the date of custody of the petitioner mentioned in paragraph 11 of the bail petition during course of the day.
Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 414/420 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.
As per the prosecution case, one stolen motorcycle was recovered from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.4069 of 2022(2) dt.31-03-2022 2/2 case on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. He is in custody since 5.9.2021. Investigation is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Motihari, East Champaran in Ghorasahan Police Station Case No. 378 of 2021.
