2. The petitioners seek regular bail in connection with Dhoraiya P.S. Case No. 229/2023 lodged on 15.08.2023 under Sections 341, 323, 325, 327, 34 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against five named accused persons including the present petitioners alleging therein that all the accused persons have assaulted the daughter of the informant due to which she got injured and in course of treatment, she died.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. From the contents of the FIR, it itself appears that due to injury received by the daughter of the informant she died. In fact, the

Patna High Court CR. MISC. No.5408 of 2024(2) dt.07-02-2024 2/2 deceased was suffering from mental problem and for which she was under treatment of a doctor which appears from Annexure2. He further submits that due to the injury took place, the said occurrence resulted. He further submits that the entire report is annexed as Annexure-2 and the petitioner No.1 is the father-inlaw whereas petitioner No.2 is gotani of the deceased. The petitioners are in custody since 16.08.2023 and are accused in one more criminal case.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Banka, in connection with Dhoraiya P.S. Case No. 229/2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
