JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 31-03-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.
The prayer for anticipatory bail of petitioner Nos. 1 and 2
Patna High Court CR. MISC. No.13262 of 2021(4) dt.31-03-2022 2/3 has already been dismissed as withdrawn vide order dated 10.01.2022.
The petitioner Nos. 3 to 9 apprehend their arrest in connection with Karjain P.S. Case No. 57 of 2020, registered for the offences punishable under Sections 147, 149, 341, 323, 307, 354 (B), 379, 504, 506 of the Indian Penal Code.
As per allegation, the accused persons named in the FIR including the petitioners badly assaulted the members of informant side.
Learned counsel for the petitioner has submitted that there is case and counter case as well as land dispute between the parties. The injury report shows that all the injuries sustained by the injured persons are simple in nature. He has also submitted that all the petitioners have clean antecedent.
Learned Addl.P.P., Shri Shailendra Kumar, fairly conceded that all the injuries are simple in nature but the opinion in respect of injured Umesh Singh is reserved, to which learned counsel for the petitioners has replied that the injuries received by Umesh Singh is attributed against co-accused Surya Narayan Singh who is not the petitioner.
Considering the above-mentioned facts and circumstances, let the petitioner Nos. 3 to 9, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
Patna High Court CR. MISC. No.13262 of 2021(4) dt.31-03-2022 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Birpur, Supaul in connection with Karjain P.S. Case No. 57 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
