JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 47(a) of the Excise Act. 23 liters of country made liquor were recovered from a motorcycle. During investigation it was found that the said motorcycle was registered in the name of Sripal Pandit but subsequently he sold it to this petitioner on 08.04.2014 whereas the seizure was made on 12.05.2014.

It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the said motorcycle was sold to this petitioner and the police, in order to save Sripal Pandit, implicated the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.8503 of 2015 (2) dt.27-02-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hilsa, Nalanda in connection with Telhara P.S. Case No. 63 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
