JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This application, for grant of anticipatory bail, arises out of Sahebganj P.S. Case No. 13 of 2017, disclosing offences under Sections 25(1-b), A/26II, 35 of the Arms Act. Prosecution case is that there is recovery of one country made pistol from the co-accused Md. Rustam, who disclosed the name of petitioner as his associate. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has been made accused only on the basis of confession of co-accused and except that there is nothing against the petitioner.

Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court

Patna High Court CR. MISC. No.1211 of 2020(2) dt.23-01-2020 2/2 below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, West Muzaffarpur, in connection with Sahebganj P.S. Case No. 13 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
