JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 302/34 of the Indian Penal Code.
Petitioner happens to be father in law of the deceased. The statement of deceased was recorded on the alleged date of occurrence at Sadar Hospital, Nawada and in the aforesaid statement deceased specifically stated that petitioner as well as one co-accused, Sona Devi poured kerosene oil on his body and lit fire. The aforesaid statement of deceased appears to be his dying declaration.
Accordingly, I am not inclined to release the
Patna High Court Cr.Misc. No.6443 of 2016 (4) dt.27-07-2016 2/2 petitioner on bail and hence, his prayer for bail in connection with Pakribarawan P.S. Case No. 243 of 2014 pending in the court of Chief Judicial Magistrate, Nawada stands rejected. However, the learned trial court should expedite the trial of the petitioner.
