JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 13.2.2014 in a case registered for the offences punishable under Sections 399,402 and 412 of the Indian Penal Code and section 25(1-B)a 26 and 35 of the Arms Act.
On information that the miscreants are preparing to commit dacoity, raid was laid. From the possession of the petitioner, one loaded pistol and one cartridge were recovered. Considering the period in custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IV, Patna in connection with S.Tr. No. 495 of 2014 arising out of Shastri Nagar
Patna High Court Cr.Misc. No.11301 of 2015 (2) dt.26-03-2015 2/2 P.S. Case No. 77 of 2014.
Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
