2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
3. As per prosecution case, informant, namely Ansniya Devi, alleges that while she was on her way to Bari in the meantime, all these F.I.R. named accused petitioners obstructed her way, verbally abused her and assaulted her with fist and slaps. Petitioner No. 1 also snatched her gold earring. It is further alleged that when husband of informant intervened, all
Patna High Court CR. MISC. No.6018 of 2025(2) dt.27-02-2025 2/3 the accused persons assaulted him with fist, slaps, stick and lathi as a result of which he sustained head injuries.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As as matter of fact, due to petty dispute over path way, an altercation took place between the parties. Allegation of assault is general and omnibus in nature and there is no specific accusation of overt act against these petitioners. Injuries sustained by the injured are simple in nature. Rest of the allegations are ornamental in order to make the case grievous. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the aforesaid facts and circumstances, nature of injuries sustained by the injured and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like
