Aggrieved by the judgment and order dated 06.12.2018 passed in C.W.J.C. No.5025/2018 passed by learned Single Judge of this Court dismissing the writ petition, the appellant has preferred this appeal.

Appellant was promoted to the post of Headmaster on 29.12.2012 and posted at Middle School, Sonaul Sultan within Purnahiya block in the District of Sheohar. Appellant was subjected to several departmental inquiries and was put under suspension, however, charges in departmental inquiry were not proved and suspension was revoked and departmental proceeding was dropped and he was transferred by the competent authority as Headmaster, Middle School, Purnahiya in the District of Sheohar and he joined the transferred place as the Headmaster on 1.2.2018.

The learned Single Judge held that transfer being incidence of service, petitioner cannot claim to remain posted at a particular place and order of transfer was neither punitive nor stigmatic but was for administrative reasons and, accordingly, dismissed the writ petition.

This Court does not find any error or infirmity in the

Patna High Court L.P.A No.17 of 2019 dt.18-02-2021 3/3 order passed by learned Single Judge and, accordingly, this LPA is dismissed.
