The petitioner seeks bail in Maheshkhunt Police Station (for brevity, PS) Case No 49 of 2019 instituted for the offence punishable under Section (s) 341, 324, 326, 307, 498A/34 of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act. The victim (wife of the petitioner) has died due to burn injuries. The Fardbayan of the victim herself was recorded prior to her death and she has made specific allegations against the petitioner-husband.
Learned counsel for the petitioner submits that the victim was having illicit relations with someone and, as such, has committed suicide.
Patna High Court CR. MISC. No.1353 of 2020(3) dt.20-03-2020 2/2 Learned APP submits that the deceased herself has impleaded the petitioner. The petitioner, being the husband, owns prime duty towards safety and honour of the victim. Considering the rival submissions, this Court is inclined to accept the submission advanced by the learned APP for the State.
