The petitioner seeks bail in Rafiganj P.S. Case No.231 of 2019 registered for the offence punishable under Section 414/34 of the Indian Penal Code..

On the allegation of recovery of a red colour Massy Ferguson Tractor, three accused persons including the petitioner were arrested, who have no valid paper of the said tractor. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in this case due to village politics, having no criminal antecedent and he is in custody since 24.09.2019. Further submission is that nothing has been recovered from the possession of the petitioner. Heard learned Addl. Public Prosecutor.

In view of facts and circumstances as well as

Patna High Court CR. MISC. No.3220 of 2020(2) dt.28-01-2020 2/2 considering nature of allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No.231 of 2019.
