The petitioner seeks bail in Kurhani P.S. Case No. 233 of 2007, registered for the offences punishable under Sections 304(B), 201, 34 of the Indian Penal Code and 3⁄4 Dowry Prohibition Act.

The prayer of the petitioner was twice rejected. It is submitted that on the last occasion vide order dated 10.02.2010 while rejecting the prayer of the petitioner a liberty was given to him to renew the prayer for bail if the witnesses does not support the prosecution case. It is submitted that the informant has already been examined as PW-4. He disclosed that his daughter died of illness. Petitioner is in jail since 27.09.2007. He has already

Patna High Court Cr.Misc. No.10385 of 2015 (2) dt.11-05-2015 2/2 remained in jail for more than seven and half years. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 10th Additional Sessions Judge, Muzaffarpur in connection with Kurhani P.S. Case no. 233 of 2007.
