NILU AGRAWAL ORAL ORDER 10-01-2019 Heard the learned counsel for the petitioner, learned counsel for the State and counsel for the Lalit Narayan Mithila University, Kameshwar Nagar, Darbhanga (hereinafter referred to as 'the university').

Petitioner retired from the post of Assistant Professor in the department of English from Samastipur College with effect from 31.12.2017 under the University. Petitioner prays the aforesaid reliefs.

Para 1(i) to (vi) (i) For a direction to the Respondents to pay to the petitioner the amount of part unutilised leave encashment 193 days under limit 300 days. (ii) For a direction to the respondents to pay to the petitioner the amount of Group Insurance with 12.5% compound interest in accordance with law.

(iii) For a direction to the Respondents to pay the petitioner the amount of D.D.A with 9% interest from the period of 1982 to 1989.

(v) For a direction to the respondents to pay to the petitioner the amount of interest of gratuity and pension by the government circular bearing No.P-C 21-16179/3155 dated 07.11.1981 and pay penal interest upon the entitle dues from the dates they became due till the dates of their respective payment. (vi) Any other relief (s) to which the petitioner be deemed entitled.

Considering the claim of the petitioner and the submission of the parties, this writ application is disposed of with a liberty to the petitioner to file a representation before the respondent no.3, the Registrar, Lalit Narayan Mithila University, Kameshwar Nagar, Darbhanga which will be disposed of within a period of four months from the date of filing of such representation.

Any amount due to the petitioner would be paid within two months thereafter. If certain amounts are in admissible, the same shall be communicated to the petitioner by a speaking order through registered post.
