1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 201, 363 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent.
4. The informant alleges that he received an information that his sister has been killed by the accused persons including the petitioners and her dead body has been buried in an orchard.
5. Learned counsel for the petitioners submits that

No.3799 of 2023(3) dt.25-08-2023 2/3 petitioners have been falsely implicated in the present case, it is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant is not an eye witness to the occurrence and the entire allegation hinges around suspicion. It is further submitted that petitioner no. 1 is cousin father-in-law of the deceased and petitioner no. 2 is cousin mother-in-law of the deceased and as such they had no connection whatsoever in the day to day life of the husband of the deceased including his family members. It is further submitted that own father-in-law and mother-in-law along with others have been granted the privilege of anticipatory bail by order dated 27.06.2023 in Criminal Miscellaneous No. 2039 of 2023 by a learned Co-ordinate Bench. It is further submitted that the husband of the deceased is in custody.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
7. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like
Patna High Court CR. MISC. No.3799 of 2023(3) dt.25-08-2023 3/3 amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sakra P.S. Case No. 399 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
