The petitioner seeks regular bail in connection with Hajipur Sadar P.S. Case No. 462 of 2019 for the offence registered under Section 392 of the Indian Penal Code. The allegation is regarding unknown miscreant having intercepted the informant and one other person whereafter they had snatched a bag containing huge sum of money. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that neither any test identification parade has been conducted so as to implicate the petitioner in the alleged crime nor the looted cash has been recovered from the petitioner herein and the seizure list would bear it out that the

Patna High Court CR. MISC. No.1197 of 2020(2) dt.16-01-2020 2/2 recovery has been made from the co-accused person, namely, Vickey Kumar. Lastly, it is submitted that the petitioner is languishing in custody since 11.10.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that neither test identification parade has been held so as to connect the petitioner with the alleged crime nor the looted cash amount has been recovered from the petitioner, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Hajipur Sadar P.S.
