1. Heard learned Counsel for the petitioners, learned Counsel for the informant and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Dalmiya Nagar Police Station Case No. 19 of 2024, dated 16.09.2024, disclosing offences punishable under Sections 191(1)/192(2)/118(1)/109/126(2)/115(2)/303(2)/ 351(2)/352/3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. The prosecution case, as per the First Information Report, is that on 15.09.2024, at about 10 PM, the petitioners, along with other co-accused persons, variously armed, came at the door of the informant, protesting the election
Patna High Court CR. MISC. No.6925 of 2025(2) dt.21-03-2025 2/3 of the informant as the President of the Durga Puja Committee and when the informant came to his house, the petitioners, along with other co-accused persons assaulted him and snatched Rs. 3,000/- from the pocket of the informant.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have not committed any offence in the manner alleged. He further submits that there is no specific allegation of assault upon the petitioners; rather, there is general and omnibus allegation against them. He further submits that similarly situated co-accused persons, namely, Deepak Kumar, Anu Kumar, Pankaj Kumar, Bhim Kumar, Ankesh Kumar, Dhirendra Kumar and Chandan Kumar, have been granted anticipatory bail by a co-ordinate Bench of this Court, vide order, dated 15.02.2025, passed in Criminal Misc. No. 5670 of 2025.
5. On the other hand, learned Counsel for the informant vehemently opposes the prayer for bail and submits that the petitioners and other accused persons assaulted the informant, due to which he received grievous injury.
6. Regards being had to the submissions advanced on behalf
Patna High Court CR. MISC. No.6925 of 2025(2) dt.21-03-2025 3/3 of the parties and taking into consideration the fact that similarly situated co-accused has been granted anticipatory bail by this Court, I am inclined to grant the petitioners privilege of anticipatory bail.
7. This application is, accordingly, allowed.
8. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Rohtas, in connection with Dalmiya Nagar Police Station Case No. 19 of 2024, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
