JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offences punishable under Sections 124A, 120B of the I.P.C. and 17 of the C.L.A. Act.

The petitioner is not named in the First Information Report and his name has transpired in the confessional statement of coaccused Suresh Ram, which is evident from the impugned order itself, that Suresh Ram was granted bail by the learned Court below itself and thereafter co-accused Shashi Ranjan Ram and Satish Kumar @ Satish Ram have also been allowed bail by another co-ordinate Bench of this Court.

In the facts and circumstances stated above, the petitioner

No.5818 of 2016 (2) dt.18-02-2016 2/2 above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IInd, Sitamarhi in connection with Sessions Trial No.182 of 2014 arising out of Runnisaidpur P.S. Case No.32 of 2011, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
