Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Tekari P.S. Case No. 605 of 2021 registered under Sections 30(a)(b)(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 20.11.2021, charge-sheet has been submitted and has antecedent of two cases and allegation is of recovery of 45 litres of liquor from the garden of Gandhi Chaudhary.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.3342 of 2022(2) dt.04-03-2022 2/2 petitioner is alleged to have been caught while fleeing, where the recovery was made does not belong to the petitioner. It is submitted that the petitioner was a passerby, who came to be implicated in the present case.
Learned APP opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1000/- (Rupees one thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum- Special Judge, Excise Act, Gaya in connection with Tekari P.S. Case No. 605 of 2021.
