Mr.Bharat Lal ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks bail in connection with Dumariyaghat P.S. Case No. 98 of 2019 registered for the offence punishable under Section 395 of the Indian Penal Code.

As per prosecution case, 6-7 miscreants came on three motorcycles, stopped the motorcycle of the informant, fired at him and snatched mobile phone, cash of Rs.50,000/- and his motorcycle. Petitioner is not named in the FIR and later on his name transpired in the confessional statement of co-accused and apart from that he is accused in two other cases. Submission of learned counsel for the petitioner is that he is in custody for more than six months, charge sheet has been submitted but he has not been put on T.I. parade. Heard learned APP also.

No.4332 of 2020(2) dt.28-01-2020 2/2 In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, East Champaran, Motihari, in connection with Dumariyaghat P.S. Case No. 98 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to appear before local police station of the area in second week of every month for a period of six months, so that the police may watch his conduct, otherwise his bail bonds shall be cancelled.

Let a copy of this order be sent to the Superintendent of Police, East Champaran for needful.
