2. This appeal has been filed for setting aside order dated 06.10.2023 passed in a case registered for the offence punishable under sections 341, 323, 324, 504 and 34 of the Indian Penal Code and Sections 3 (i) (r) (s) of the Scheduled Castes and Scheduled Tribes (POA) Act, whereby the prayer for anticipatory bail of the appellant has been rejected. 3 . As per the prosecution case , informant alleged that

APP (SJ) No.329 of 2024(4) dt.31-07-2025 2/3 on on 21.05.2023 , when informant was going to his home , in the meantime all the F.I.R. named accused persons including this appellant aabused him by caste name and assaulted him with fists and also strangulated the neck of informant.

4. It is submitted that both the parties are co-villagers and due to petty dispute this false and concocted case has been lodged against this petitioner. It is further submitted that during pendency of the case that with the intervention of well wishers the present case , has been compromised in between the parties for which a compromise petition was filed in the Court below on 11.04.2025 .

5 . Learned counsel for the respondent No. 2 as well as learned special Public Prosecutor for the State does not dispute the contention made on behalf of appellant.

6. Considering the fact that the dispute between the parties has already been settled and other circumstances of the case , this appeal is allowed and the impugned order is set aside. Let the appellant, named above, in the event of arrest/surrender within a period of eight weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned
