JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court, giving direction to the trial court to expedite the trial of the petitioner. The trial court has reported vide letter No. 192/15 dated 16-07-2015 that out of 8 proposed prosecution witnesses, three prosecution witnesses have already been examined and trial court has sought six months more time for conclusion of trial of the petitioner.

Taking note of the aforesaid facts and circumstances as well as submission of the parties, prayer for bail of the petitioner in connection with S. Tr. No. 19 of 2013/142 of 2013 arising out

Patna High Court Cr.Misc. No.13225 of 2015 (3) dt.07-09-2015 of Bodh Gaya P.S. Case No. 105 of 2012 stands rejected. However, learned Ad hoc Additional Sessions JudgeIInd, Gaya is directed to send a list of remaining proposed prosecution witnesses to Sr. Superintendent of Police, Gaya fixing a date for examination of aforesaid prosecution witnesses within a week from the date of receipt/production of copy of this order and if, the learned Ad hoc Additional Sessions Judge-.IInd, Gaya does so, the Sr. Superintendent of Police, Gaya shall ensure the presence of remaining prosecution witnesses before the trial court within the period, as fixed by the trial court, failing which, the matter shall be viewed seriously.

Let a copy of this order be sent to Superintendent of Police, Gaya without any delay.
