The petitioner seeks bail in a case registered for the offence punishable under Sections 18 and 20 of the Narcotic Drugs and Psychotropic Substances Act. The allegation is that the raiding party on 5.2.2015 found seven big plants of Ganja standing in the courtyard of the petitioner and 900 grams of Ganja like substance drying on a cot.

It is submitted on behalf of the petitioner that from the seizure list it appears that 900 grams of Ganja was seized. The petitioner is 70 years old. He is a Pujari in a local temple and mainly used to reside in the said temple. The seized quantity of Ganja is less than the commercial quantity. The petitioner has no criminal antecedent.

Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.15334 of 2015 (2) dt.03-06-2015 2 / 2 each to the satisfaction of learned Sessions Judge, Nawada in Special Case no. 2 of 2015 arising out of Akbarpur P.S. Case No. 24 of 2015 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
