The petitioner is in custody since 28.11.2019 in connection with Bhagwanpur P.S. Case No.218 of 2019 registered for the offence under Section 30(A) of Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that the alleged recoveries of Mahua wine were not from the conscious possession of the petitioner but from joint house in which the petitioner also resides. The petitioner is not having any criminal antecedent.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent,
Patna High Court CR. MISC. No.1178 of 2020(2) dt.20-01-2020 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Kaimur at Bhabua, in connection with Bhagwanpur P.S. Case No.218 of 2019.
